End-User License Agreement (EULA)
License Grant:
DistantDare grants the End User a non-exclusive, non-transferable license to use the Software in accordance with the terms and conditions set forth herein.
Scope of Use:
The license is granted for the purpose of using the Software for its intended functionality. The End User may not copy, modify, reverse engineer, or attempt to derive the source code of the Software.
Ownership:
The Software is the property of DistantDare and is protected by intellectual property laws. The End User acknowledges and agrees that DistantDare retains all rights, title, and interest in and to the Software.
Restrictions:
The End User may not sublicense, rent, lease, or transfer the Software to any third party. Any unauthorized use or distribution of the Software is a violation of this EULA and may result in the termination of the license.
Disclaimer of Warranty:
The Software is provided "as is" without warranty of any kind. DistantDare] disclaims all warranties, express or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose.
Limitation of Liability:
In no event shall DistantDare be liable for any consequential, incidental, direct, indirect, special, or punitive damages, or any damages whatsoever, arising out of or in connection with the use or inability to use the Software.
Termination:
This EULA is effective until terminated. The license will terminate automatically if the End User fails to comply with any provision herein. Upon termination, the End User must cease all use of the Software and destroy all copies in their possession.
Governing Law:
This agreement shall be governed by and construed in accordance with the laws of The Netherlands. Any legal action or proceeding arising under this EULA shall be brought exclusively in the courts located in The Netherlands.
By installing or using the Software, the End User acknowledges that they have read and agree to be bound by the terms and conditions of this EULA.
